Terms of Service

These terms govern your use of the Shine OS website and app, operated by Shine Health (“we”, “us”). By using Shine OS you accept them. If you do not agree, please do not use the service.
What Shine OS is
Shine OS is a wellness tool built on the coaching framework of founder Lacey Rochelle. It scores 8 areas of your health through a short check-in, helps you build and track daily habits, and writes progress reports each time you check in.

Shine OS provides general wellness information only. It is not a medical device and does not diagnose, treat or prevent any condition. Scores, suggested habits and progress reports — including reports written by AI — are general guidance, may be incomplete or wrong, and are not a substitute for advice from a doctor or other qualified health professional.
Talk to your doctor before starting a new exercise, nutrition or supplement routine, or changing any medication, especially if you are pregnant or have a medical condition. Never ignore professional advice or delay seeking it because of something you read here.

Your account
You sign in with a Google account and must be at least 16 years old. Keep your Google account secure; you are responsible for activity under your account. Please give accurate answers — your scores and reports are only as good as the information you enter.
Membership and payments
Paid plans are not available yet. When they launch, the price, billing period and how to cancel will be shown clearly before you subscribe, and you will only be charged after you agree. Chat feedback and expert check-ins are coaching, not medical care. Nothing in these terms limits your rights under the Australian Consumer Law or other consumer protection laws that apply to you.
Acceptable use
You may use Shine OS for your own personal wellness. You may not:
- access another person's account or data, or try to;
- probe, breach or disrupt the security or availability of the service, or get around any access control;
- scrape, copy or republish the service's content, questions or design as a competing product;
- use the service unlawfully, or to harass, mislead or harm anyone.
Your information
Your check-ins, habits and reports belong to you. You allow us to store and process them only to provide the service, as described in our Privacy Policy. You can ask us to delete them at any time.
Intellectual property
The Shine OS name, logo, design, text, questions, framework and code belong to Shine Health and its founder. Third-party names and trade marks belong to their owners; their use here implies no affiliation or endorsement. If you believe something here infringes your rights, write to [email protected] identifying the material and your rights in it, and we will review it promptly.
Availability and changes to the service
We work to keep Shine OS running, but we do not guarantee it will always be available or error-free, and we may change or discontinue features. If we close the service, we will give you reasonable notice and a chance to request a copy of your data.
Disclaimers and liability
To the fullest extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential or punitive damages, or lost profits, arising from your use of the service or reliance on it. Where liability cannot be excluded, it is limited to the greater of the fees you paid us in the 12 months before the claim and AUD 100.
Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot lawfully be limited. If you are a consumer, you keep all rights that cannot be excluded under the law where you live, including the consumer guarantees under the Australian Consumer Law and, in the EU and UK, your statutory rights.
Ending your use
You can stop using Shine OS at any time and ask us to delete your account. We may suspend or close accounts that break these terms or put the service or other users at risk.
Changes and governing law
We may update these terms; the date above will change, and we will tell you about material changes in the app or by email. Continuing to use Shine OS after a change means you accept it. These terms are governed by the laws of the place where Shine Health is established, without affecting the mandatory consumer protections available to you where you live.
